Ban Hamas from Twitter

Dear [Decision Maker],

As an American citizen who is concerned about global terrorism, I was deeply disturbed to learn that your company is permitting the terrorist organization Hamas to use your services to spread its message and accomplish its goals.

The United States government has designated Hamas as a Foreign Terrorist Organization. Under 18 U.S.C. 2339A, it is illegal for any U.S. Company to provide "material support" to a terrorist organization. This prohibited material support specifically includes "services" and "communications equipment." By allowing Hamas to have a Twitter account, you are providing it with an important "service" and extremely effective "communications equipment" which are central to its primary mission of terrorizing the Israeli people and using civilian deaths to score political points.

In its February 2010 opinion in Holder v. Humanitarian Law Project, the United States Supreme Court stressed that support for terrorists need not be directly linked to the commission of violent attacks to violate the material support statute.

In addition, permitting Hamas to use Twitter violates your own Terms of Service. In particular, I'd refer you to those portions of your rules which limit use of your service to those who "are not a person barred from receiving services under the laws of the United States" and which prohibit the use of your service "in furtherance of illegal activities."

I therefore demand that you observe both United States law and your own Terms of Service by immediately banning Hamas, the Izzadeen Al-Qassam Brigades and any related entities from operating Twitter accounts (e.g. @AlqassamBrigade). I have cc'd the local office of the United States Attorney on this e-mail so that they can weigh appropriate legal measures in the event that you continue to permit terrorists to use your services.
