The reinstitution of the refundable adoption tax credit, through the Adoption Tax Credit Refundability Act of 2015 will help provide access and relief to those who would otherwise not be able to build their family through adoption.

Although the adoption tax credit was made permanent in the American Taxpayer Relief Act of 2012 (the so-called “Fiscal Cliff” law), this new legislation will restore the refundable portion of the credit which was in place in 2010 and 2011. This legislation is critical to creating financial flexibility for families seeking to adopt.

While the Adoption Tax Credit was made permanent in 2012, it lost a key provision when it was made permanent: it is no longer refundable. This is devastating to many low and middle-income adoptive parents. A refundable Adoption Tax Credit makes an enormous difference in terms of which families are able to claim the credit. Many parents who provide loving homes to waiting children cannot use the non-refundable adoption tax credit at all and these are among those who need it most. Please co-sponsor S 950 which will make the Adoption Tax Credit refundable.
