Webinar This Thursday on Submitting Comments on CMS's Proposed Nursing Home Staffing Standard

Join us this Thursday, October 19th at 2:00pm ET for a webinar, A Guide to Submitting Comments on CMS's Proposed Nursing Home Staffing Standards. On September 6, 2023, the Centers for Medicare & Medicaid Services (CMS) released the long-awaited Notice of Proposed Rulemaking (NPRM) that proposed a minimum staffing standard in nursing homes. While Consumer Voice supports a minimum staffing standard, the proposed staffing standard does not go far enough to protect nursing home residents. The NPRM is now in the 60-day comment period, and comments are due on 11/6/2023. It will be critical that CMS hears from you that this rule needs to be stronger.

Thursday's webinar will provide guidance on how to comment on critical provisions of the NPRM, including:

  • The need for a stronger minimum staffing standard.
  • Reducing the timeframes for implementation of the rule.
  • CMS’s proposal to allow certain nursing homes exemptions from the standard.
  • Support for the 24/7 RN requirement.
  • Facility assessments.
  • Medicaid Transparency.

New Resource from Justice in Aging and NAELA on Federal Medicaid Law and Assisted Living

A new resource from Justice in Aging and the National Academy of Elder Law Attorneys (NAELA), Federal Medicaid Law and Assisted Living Advocacy: What to Do When a Facility Refuses to Accept Medicaid, or Attempts to Evict Without Offering Appeal Rights, provides advocates with legal analysis and advocacy strategies. Two provisions of federal Medicaid law — one historically underutilized, the other brand new — offer protections for assisted living residents in facilities that accept Medicaid. The resource provides advocacy strategies for two situations: when 1) a facility refuses to accept Medicaid from a resident who has become Medicaid-eligible while living in the facility, or 2) a facility attempts to evict a resident with inadequate notice or opportunities to appeal the eviction.

Long-Term Care Equality Index Advisory Committee Accepting Applications for New Members

The Long-Term Care Equality Index (LEI), a joint project of SAGE and the Human Rights Campaign Foundation, is a national benchmarking tool for LGBTQ+ inclusion in senior housing and residential long-term care communities. With free resources, technical assistance and a biennial survey, the LEI helps communities implement, strengthen, and innovate their LGBTQ+ inclusion efforts.

The LEI Advisory Council is made up of diverse individuals across the country who advise on matters that directly concern the LEI project and outreach. The Council is made up of individuals who have a professional and/or personal connection to residential long-term care and senior housing.

The Council is now accepting applications for new members. Apply by Dec 15, 2023. A decision will be made by early February 2024.

In order to ensure that a diversity of community voices are included, the LEI Advisory Council is currently seeking to add representation from people who have a connection to residential long-term care/senior housing and hold one or more of the following identities:

  • People who live in the Southeastern, Southwestern, and Western regions of the US
  • People who live in a rural location (fewer than 2,500 people) in any region.
  • People who identify as a person of color
  • People whose current gender identity is Transgender, Nonbinary, or Two-Spirit.
  • People with a diverse range of life, educational, and professional experiences
